These Terms & Conditions govern your access to and use of MyHome360.in and the property and home-related services available through the Platform.

Important Legal Notice

This document is a business-oriented draft prepared for MyHome360.in. It is intended to provide a detailed framework for website and service terms and should be reviewed and customized by a qualified lawyer in India before publication or use as a binding contract.

Introduction

These Terms & Conditions (“Terms”) govern access to and use of the MyHome360.in website, platform, applications, communication channels and services (collectively, the “Platform”).

MyHome360.in (“MyHome360”, “we”, “us”, or “our”) provides a platform and/or service coordination interface relating to property and home-related requirements, including buying, selling, renting, construction, renovation, interior services, shifting, cleaning, pest control, documentation support, home assistance and other services that may be introduced from time to time.

By accessing the Platform, creating an account, submitting an enquiry, requesting a service, communicating with a listed service provider, or otherwise using the Platform, you acknowledge that you have read, understood and agreed to these Terms, together with any applicable service-specific terms, quotation, order, agreement or policy.

Definitions

  • “User” means any person who visits, accesses or uses the Platform.
  • “Customer” means a User who requests, purchases or receives a service through or in connection with MyHome360.
  • “Property” means any residential, commercial, land or other real-estate asset referred to on the Platform.
  • “Service Provider” or “Vendor” means an independent third party, contractor, professional, agent or business providing services to a Customer.
  • “Listing” means property, service, vendor or other information displayed on the Platform.
  • “Order” means a confirmed request for a service, where applicable.
  • “Platform Content” means text, images, logos, graphics, software, data and other content made available by MyHome360.

Acceptance and Eligibility

You must use the Platform only for lawful purposes and in accordance with these Terms.

By using the Platform, you represent that the information you provide is accurate and that you have legal capacity to enter into an agreement.

If you use the Platform on behalf of another person or entity, you confirm that you are authorized to do so.

Nature and Scope of MyHome360 Services

MyHome360 may act as a platform, facilitator, coordinator, marketplace, referral service or direct service provider, depending on the particular service.

The exact role of MyHome360 shall be stated in the relevant quotation, order, service description or agreement where applicable.

Services may include property discovery and enquiries, buy/sell/rent assistance, construction and renovation coordination, interior services, shifting assistance, cleaning, pest-control coordination, documentation support, home assistance and other services.

Availability, geographical coverage, pricing and service scope may change without notice.

Property Listings

Property information may be supplied by owners, brokers, agents, developers, vendors, users or other third parties.

Although MyHome360 may perform reasonable checks or request supporting information, no listing should be treated as a guarantee of ownership, title, legality, approvals, dimensions, construction quality, possession status, market value, availability or any other attribute unless expressly verified and stated in writing by MyHome360.

  • Users must independently inspect and verify a property before entering into any transaction.
  • Users should verify title, ownership, encumbrances, approvals, land-use status, taxes, dues, possession, measurements and applicable government records.
  • MyHome360 is not responsible for inaccurate, incomplete, outdated, misleading or fraudulent information supplied by a third party, subject to applicable law.
  • MyHome360 may edit, suspend, reject or remove listings that violate law, these Terms or Platform policies.

Buying, Selling and Renting Property

MyHome360 may connect prospective buyers, sellers, landlords, tenants, agents and other participants.

Unless expressly stated otherwise in a separate written agreement, MyHome360 is not a party to the underlying sale, purchase, lease, licence or other property transaction between users.

Premium Properties and chargeable listings may additionally be subject to the brokerage terms in Section 6A.

Any token, advance, deposit, rent, brokerage, registration charge, professional fee, service charge or other amount shall be governed by the applicable transaction or service arrangement. Users should obtain appropriate legal, financial and property advice before committing funds.

Premium Properties and Brokerage Charges

Certain properties, listings or transactions may be designated by MyHome360 as “Premium Properties” or “Premium Listings” based on factors such as property category, location, value, exclusivity, owner mandate, special services, marketing package or transaction requirements.

Brokerage, facilitation, service, consultation or transaction charges (“Brokerage Charges”) may apply to Premium Properties and to other property transactions where such charges are disclosed or agreed.

The applicable amount may be a fixed fee, percentage of the transaction value, periodic amount, or another amount stated in the relevant quotation, listing, mandate, service agreement or written communication.

Where brokerage is applicable, the User shall be informed of the applicable Brokerage Charges, payment stage and applicable taxes/charges before or at the time of confirmation, to the extent reasonably practicable.

Brokerage may become payable where MyHome360 introduces, facilitates, coordinates or materially assists a transaction involving a Premium Property or other chargeable listing, including where the transaction is completed directly between the parties after the introduction, subject to the terms communicated for that listing or service and applicable law.

A User must not intentionally bypass MyHome360, conceal a transaction, provide misleading information or use information obtained through the Platform to avoid an applicable Brokerage Charge.

Unless expressly stated otherwise, Brokerage Charges are separate from stamp duty, registration fees, taxes, legal fees, loan-processing fees, society charges, documentation charges and other government or third-party expenses.

Brokerage terms may differ between buyers, sellers, landlords, tenants and other parties. The specific written terms applicable to a particular Premium Property or transaction shall prevail over general descriptions on the Platform, subject to applicable law.

If a Premium Property is withdrawn, sold, rented, modified or becomes unavailable, MyHome360 may update or remove its listing. Such removal does not automatically cancel any brokerage or payment obligation that has already validly accrued.

Construction, Renovation and Interior Services

Where MyHome360 coordinates construction, renovation or interior services, the scope, specifications, materials, timeline, price, milestones, warranties and responsibilities should be recorded in a quotation, work order or separate written agreement.

  • Changes to design, material, quantity or scope may result in additional charges and revised timelines.
  • Estimated completion dates are subject to site conditions, approvals, material availability, labour availability, weather and other factors.
  • Workmanship, material and warranty obligations shall be determined by the applicable contract and responsible contractor/vendor.
  • Customers are responsible for providing timely site access, approvals, decisions, measurements and information reasonably required for the work.

Home Shifting and Related Services

For shifting, packing, loading, transportation, unloading, unpacking or related services, the service scope and applicable charges shall be communicated before confirmation where practicable.

Customers should disclose fragile, valuable, restricted or unusually large items.

Unless expressly agreed otherwise, liability for loss or damage, if any, shall be governed by the applicable service provider's terms, the written quotation/order and applicable Indian law.

Cleaning, Pest Control and Home Assistance

Service results may vary depending on property condition, infestation level, surface/material type, access and other site-specific factors.

Customers must follow reasonable preparation, safety and post-service instructions provided by the relevant provider.

Third-Party Vendors and Professionals

Many services may be performed by independent third parties. Unless expressly stated otherwise, such providers are not employees of MyHome360.

MyHome360 may facilitate communication, scheduling, quotations or payments but does not automatically guarantee a vendor's performance.

  • Vendors are responsible for their personnel, licences, tools, materials, workmanship and legal compliance.
  • Customers should review quotations and service terms before accepting work.
  • Any dispute regarding workmanship or service quality should first be raised through the applicable support channel and, where appropriate, directly with the provider.

User Information and Accounts

Users must provide accurate, current and complete information when submitting enquiries or creating accounts.

Users are responsible for maintaining the confidentiality of login credentials and for activity conducted through their account.

MyHome360 may contact users through phone, SMS, email, WhatsApp or other communication channels regarding enquiries, bookings, service updates, support, offers and important Platform notices, subject to applicable law and user preferences.

Quotes, Pricing and Payments

Prices may depend on service scope, location, materials, labour, taxes, urgency and other factors.

A displayed or estimated price is not necessarily a final price unless expressly identified as such.

  • Applicable taxes, government charges and third-party charges may be additional unless included in the quoted amount.
  • Payment schedules, deposits, milestones, cancellation charges and refunds shall be governed by the applicable service terms or quotation.
  • Users must not attempt unauthorized chargebacks, payment manipulation or fraudulent transactions.
  • Where MyHome360 collects money on behalf of a vendor, its role and applicable refund process should be stated in the relevant transaction terms.

Cancellation, Rescheduling and Refunds

Cancellation and refund eligibility may vary by service because vendors may incur travel, booking, labour, procurement or other costs.

The applicable cancellation policy communicated at booking or in the service agreement will apply.

Where no specific policy has been communicated, MyHome360 will assess the request reasonably, subject to applicable law and the rights and obligations of the relevant third-party provider.

Verification and Due Diligence

Users are solely responsible for conducting appropriate due diligence before making financial or legal commitments.

For property transactions, users should obtain independent legal and financial advice and verify original documents with competent authorities or professionals.

User Conduct

  • Do not provide false, misleading, forged or fraudulent information.
  • Do not upload or transmit unlawful, defamatory, abusive, infringing or malicious material.
  • Do not impersonate another person or entity.
  • Do not interfere with Platform security or attempt unauthorized access.
  • Do not scrape, copy, reproduce or commercially exploit Platform data without permission.
  • Do not use the Platform to facilitate illegal transactions, fraud, harassment or other unlawful activities.

User-Generated Content

If a User submits reviews, photographs, property information, comments or other content, the User represents that they have the necessary rights to submit it and that it does not violate applicable law or third-party rights.

By submitting content, the User grants MyHome360 a non-exclusive, royalty-free licence to host, reproduce, display and use the content for operating, improving and promoting the Platform, subject to applicable law.

Intellectual Property

The MyHome360 name, logo, branding, website design, software, text, graphics and other Platform Content are owned by or licensed to MyHome360 and are protected by applicable intellectual-property laws.

No ownership rights are transferred to Users by virtue of accessing the Platform.

Privacy and Data

Personal information may be collected and processed to provide services, respond to enquiries, facilitate vendor communication, improve the Platform, prevent fraud and meet legal obligations.

The detailed handling of personal data should be described in MyHome360's Privacy Policy, which forms part of the Platform's policy framework.

Disclaimers

To the maximum extent permitted by applicable law, the Platform and its information are provided on an “as available” basis.

MyHome360 does not guarantee uninterrupted availability, complete accuracy of third-party information, specific transaction outcomes, property appreciation, rental returns, construction completion by a particular date, or the performance of every independent service provider.

Limitation of Liability

To the maximum extent permitted by law, MyHome360 shall not be liable for indirect, incidental, special, consequential or punitive losses, loss of profits, loss of opportunity, loss of data or business interruption arising from use of the Platform or third-party services.

Where liability cannot legally be excluded, it shall be limited to the extent permitted by applicable law and, where legally permissible, to the amount actually paid to MyHome360 for the relevant service giving rise to the claim.

Indemnification

To the extent permitted by law, a User agrees to indemnify and hold harmless MyHome360 and its directors, employees, representatives and service partners from claims, losses, liabilities, costs and reasonable expenses arising from the User's breach of these Terms, misuse of the Platform, violation of law, or infringement of third-party rights.

Suspension and Termination

MyHome360 may suspend or terminate access to the Platform where it reasonably believes that a User has violated these Terms, engaged in fraud or unlawful activity, created a security risk, or otherwise misused the Platform.

Termination does not affect rights or obligations that accrued before termination.

Third-Party Links and Services

The Platform may contain links or references to third-party websites, applications, payment providers or services.

MyHome360 is not responsible for third-party content, availability, privacy practices or terms. Users should review the applicable third-party terms.

Force Majeure

MyHome360 shall not be responsible for delay or failure caused by events beyond reasonable control, including natural disasters, fire, flood, epidemic, war, civil disturbance, government restrictions, strikes, internet or infrastructure failures, transportation disruptions or other force-majeure events.

Complaints and Customer Support

Users should first contact MyHome360 through the official support/contact channel published on the Platform with relevant order, property or enquiry details.

MyHome360 may investigate complaints and coordinate with the relevant provider where appropriate.

Dispute Resolution

The parties should first attempt to resolve disputes through good-faith communication.

Where a dispute cannot be resolved amicably, the dispute shall be subject to the jurisdiction and dispute-resolution mechanism specified in the applicable service agreement.

Unless a different legally valid arrangement applies, these Terms shall be governed by the laws of India, subject to applicable consumer-protection and other mandatory laws.

Changes to These Terms

MyHome360 may update these Terms from time to time to reflect changes in services, technology, business practices or applicable law.

The updated version will be published on the Platform with an updated effective date.

Continued use after the effective date constitutes acceptance of the revised Terms, to the extent permitted by law.

Severability

If any provision of these Terms is held invalid, unlawful or unenforceable, that provision shall be modified or severed to the minimum extent required, and the remaining provisions shall continue in effect.

Entire Agreement

These Terms, together with applicable service-specific terms, quotations, orders, agreements and policies referenced by MyHome360, constitute the agreement governing the relevant use of the Platform or service, except where a separate written agreement expressly overrides these Terms.

User Acknowledgement

By using MyHome360.in, the User confirms that they have had a reasonable opportunity to read these Terms and agrees to comply with them.

The User understands that property transactions and third-party home services may involve independent risks and that appropriate verification and professional advice should be obtained before making significant financial, legal or contractual commitments.
